1. Purpose

These Terms & Conditions ("Terms") govern your access to and use of the Haerye ("Service"). By using the Service, you agree to be bound by these Terms.

2. Definitions

  • Service: The Haerye web app and any related features or content provided by the Operator.
  • User: Anyone who accesses or uses the Service.
  • Member: A User who creates an account and signs in to the Service.
  • Paid Service: Monthly subscription-based features/benefits offered for a fee.
  • Content: Any materials provided through the Service (text, images, data, UI, learning materials, etc.).

3. Changes to the Service and Terms

The Operator may update the Service or these Terms as needed for operational, security, or legal reasons. If material changes are made, the Operator will provide notice in a reasonable manner.

4. Accounts

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You must provide accurate information when creating and managing your account.
  • The Operator may restrict or suspend accounts if abuse, fraud, or security risks are detected.

5. Acceptable Use

You agree not to:

  • Use the Service in a way that disrupts, damages, or interferes with its normal operation.
  • Attempt unauthorized access, reverse engineering, scraping, or exploitation of vulnerabilities.
  • Copy, distribute, sell, or commercially exploit the Content without permission.
  • Violate applicable laws or infringe on the rights of others.

6. Intellectual Property

The Service and its Content are owned by the Operator or the respective rights holders. Using the Service does not grant you any ownership rights in the Service or Content.

6-1. Learning Content Ownership and License

All learning materials provided through the Service, including but not limited to vocabulary data, grammar explanations, examples, exercises, datasets, localized or translated materials, language packs (e.g., translation JSON files), and other educational content ("Learning Content"), are created, curated, and owned exclusively by the Operator.

Some Learning Content may have been generated or assisted using artificial intelligence (AI) tools. Notwithstanding the use of such tools, all rights, title, and interest in the Learning Content remain solely with the Operator.

The Learning Content is licensed to Users for personal, non-commercial learning purposes only. Users may not copy, reproduce, distribute, modify, translate, resell, sublicense, publicly display, or otherwise exploit the Learning Content, in whole or in part, without prior written permission from the Operator.

Accessing or using the Service does not transfer any ownership rights in the Learning Content to Users.

7. Paid Service (Monthly Subscription)

Certain features may be available only through a monthly subscription. Pricing, billing cycle, and benefits will be shown on the subscription/payment screens.

8. Refunds and Cancellation

Refund requests must be submitted to the Operator at PKC@haerye.com. The Operator reviews each request according to the Refund Policy.

Upon approval, it may take approximately 10 business days for the refund to be processed and reflected in your account via our Merchant of Record.

8-1. AI-Powered Conversation (OpenAI API)

The Service may provide an AI-powered conversation feature that generates responses using a third-party AI service provider (OpenAI API). When you use this feature, the text you enter (and limited recent conversation context, if provided) may be transmitted to OpenAI to generate a response.

  • No direct identifiers: we do not intentionally send your email address, Firebase UID, or other directly identifying personal information to OpenAI for response generation.
  • No conversation storage by us: we do not store AI conversation content in our database after a response is generated.
  • Voice features: any speech-to-text or text-to-speech functions in the Service may use your browser’s Web Speech API (not OpenAI).
  • Third-party terms: your use of this feature may be subject to OpenAI’s applicable policies and technical safeguards.

9. Disclaimer and Limitation of Liability

The Service is provided on an "as is" and "as available" basis. Certain outputs (including AI-generated conversation responses) may be inaccurate, incomplete, or inappropriate. AI-generated content is for general learning purposes only and is not professional advice. To the maximum extent permitted by law, the Operator is not liable for indirect, incidental, or consequential damages.

10. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Korea, unless otherwise required by applicable law. Any disputes shall be resolved through good-faith consultation, and if necessary, through the competent court.
